ARCK is a wholesale supplier of electrical goods to trade customers. The site, our pricing, and our supply arrangements are designed for buyers who are licensed electrical contractors, electricians, builders, or other trade professionals, or who are purchasing goods for installation by a licensed electrical worker.

By placing an order, you warrant that:

• You are at least 18 years of age and have legal capacity to enter into this agreement.
• Any electrical goods purchased will be installed, connected, or used by a person who holds the appropriate electrical licence, qualification or certification required by the laws of the State or Territory in which the goods are installed or used.
• You will comply with all applicable laws, regulations, Australian Standards, and manufacturer instructions in relation to the use, installation, and disposal of the goods.

ARCK is not liable for any loss, damage, injury or non-compliance arising from unlicensed installation, misuse, or improper application of the goods. The buyer indemnifies ARCK against any claim, loss, damage, fine, penalty or expense (including reasonable legal costs) arising from the installation, connection or use of the goods by a person who does not hold the appropriate electrical licence, qualification or certification required by the laws of the relevant State or Territory.

All prices on the site are displayed in Australian Dollars (AUD) and, unless stated otherwise, are inclusive of GST.

All orders placed through the site are prepaid. Payment must be received in full and cleared before goods are dispatched. We do not currently offer credit terms or accounts through the online store.

We may refuse or cancel an order where: (a) stock is unavailable; (b) a pricing or product description error has occurred; (c) we suspect fraud or misuse; (d) the buyer is in breach of these Terms; or (e) the buyer has not warranted that a licensed person will install or use the goods. Where an order is cancelled, we will contact you and refund any amounts paid in full. We may limit quantities per order or per customer where reasonably necessary.

A submitted order is an offer to purchase. The contract between you and ARCK is formed when we accept your order by sending an order confirmation or dispatch notification. Until that point, we may decline the order without liability.

Written quotations are valid for 14 days from the date issued, unless stated otherwise. Quotations are subject to stock availability and may be withdrawn or varied prior to acceptance. Quoted prices are exclusive of freight unless expressly stated.

• Images are indicative only — actual product appearance, packaging, and inclusions may vary.
• Specifications, datasheets, and standards compliance information are provided as a guide. You should verify product suitability for your application against the manufacturer’s current documentation before installation.
• Stock levels are updated regularly but are not live; we will contact you if an ordered item is unavailable.
• You are responsible for verifying quantities, measurements, dimensions, voltages and specifications before ordering. ARCK is not liable for losses arising from genuine quotation errors or from specifications, drawings, plans or measurements supplied by you.

The following items are cut, made or modified to your order from bulk stock and are not eligible for return, refund, exchange or store credit under any circumstances — including change-of-mind, incorrect specification, wrong length, or unused condition:

• Cable, conduit and cable duct sold by the cut length or metre
• LED strip lighting and tape light cut to a customer-specified length
• Any other product cut, fabricated, terminated, drilled, modified or assembled to a customer-supplied specification, dimension, drawing or instruction
• Any product where the original factory seal or manufacturer packaging has been broken or removed

By ordering cut, made-to-order or customer-specified goods, you warrant that the length, dimensions, ratings and specifications you have provided are correct, and you indemnify ARCK against any loss arising from incorrect specifications, measurements, drawings or instructions supplied by you. Your rights under the Australian Consumer Law for genuine faults or major failures in the goods themselves still apply. See our Returns & Refund Policy for the full process.

Risk in the goods passes to you on delivery to your nominated address or, where you pick up from our branch, on collection.

Title in the goods passes to you when ARCK has received cleared payment in full for those goods. As all online orders are prepaid, title generally passes on dispatch.

Returns, refunds and warranty claims are handled under our Returns & Refund Policy, which forms part of these Terms.

All content on the site — including text, images, logos, product photography, designs, layouts, and software — is owned by or licensed to ARCK and is protected by Australian and international copyright and trade mark laws.

You may not reproduce, copy, scrape, republish, sell, or commercially exploit any part of the site or its content without our prior written permission. Use of automated tools to copy, harvest or republish site content is prohibited.

When using the site, you must not:

• Use the site for any unlawful purpose or to encourage unlawful conduct
• Attempt to gain unauthorised access to the site, its servers, accounts, or any connected systems
• Introduce viruses, malware, or any other harmful code
• Use automated tools, bots, or scrapers to collect data from the site
• Resell, redistribute, or commercially exploit content from the site
• Submit false, misleading, or fraudulent information
• Impersonate any person or misrepresent your affiliation with any person or organisation

We may suspend or terminate your access at any time if we reasonably believe you have breached these Terms.

The site may contain links to third-party websites or services that are not controlled by ARCK. We are not responsible for the content, accuracy, or practices of those third parties. Your dealings with third parties are at your own risk.

To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law:

• ARCK’s total aggregate liability to you for any claim, or series of related claims, arising out of or in connection with the supply of goods or use of the site is capped at the total invoice value of the goods to which the claim relates (excluding freight and taxes), and at our option will be satisfied by: (a) replacement of the goods or supply of equivalent goods; (b) repair of the goods; or (c) refund of the price paid for those goods.
• ARCK is not liable for any indirect, consequential, special, incidental, exemplary, punitive or economic loss, including but not limited to: loss of profit, loss of revenue, loss of anticipated savings, loss of business, loss of contracts, loss of goodwill, loss of opportunity, business interruption, downtime, delay costs, or third-party claims, however arising and whether or not foreseeable.
• ARCK is not liable for loss or damage caused by incorrect installation, installation by an unlicensed or unqualified person, misuse, modification, or use of the goods contrary to manufacturer instructions, Australian Standards, or applicable laws.
• ARCK is not liable for loss arising from specifications, dimensions, drawings, measurements or instructions supplied by the buyer, or from the buyer’s failure to verify the suitability of the goods for their intended application.

You agree to indemnify ARCK against any claim, loss, damage, liability or expense (including reasonable legal costs) arising out of:

• Your breach of these Terms
• Your misuse of the goods or site
• Any installation or use of the goods by an unlicensed or unqualified person
• Any breach by you of applicable laws, regulations or Australian Standards

ARCK is not liable for any delay or failure to perform our obligations caused by events outside our reasonable control, including but not limited to: natural disasters and severe weather, fire, flood, earthquake, war, terrorism, riot or civil disturbance, pandemic or epidemic, industrial action or labour dispute, government order or restraint, freight carrier failure or delay, manufacturer or supplier failure or product discontinuation, raw material or energy shortage, or failure of utilities or telecommunications.

If a force majeure event continues for more than 30 days, either party may terminate the affected order on written notice and ARCK will refund any prepaid amounts for goods not yet dispatched. Performance of obligations not affected by the event must continue.

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

If any provision of these Terms is held to be invalid or unenforceable, that provision is severed to the extent required and the remaining provisions continue in full force.

A failure or delay by ARCK to enforce any right under these Terms does not waive that right.

We may update these Terms from time to time. The current version is always available on the site. Your continued use of the site after changes are posted constitutes acceptance of those changes.

These Terms are governed by the laws of New South Wales, Australia. You and ARCK submit to the exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.

Before commencing any court proceedings (other than for urgent interlocutory relief), the parties agree to attempt to resolve any dispute in good faith by direct discussion, and failing resolution within 21 days, by referral to mediation through the Resolution Institute or another mediator agreed by the parties.
